Credit Gathering Authorization

By indicating Your agreement to these terms (for example, by clicking the button where You accept this credit gathering authorization) You represent that You are authorized on behalf of Yourself and the business listed in Your application (individually “You” or “Your” or collectively, the “Applicant”) to make and submit representations regarding the Applicant to Spectra Lending, LLC, its representatives, subsidiaries, and affiliates (collectively, “Spectra”) and to third-party lenders, finance companies, service providers and financial services companies, or other third parties that are involved with or provide commercial loans or purchases of receivables (individually a “Recipient” or collectively the “Recipients”). You authorize Spectra and the Recipients to conduct, obtain, receive, and process a review of You and/or Your business that Spectra or any Recipient considers appropriate to process and evaluate Your application for business-purpose financial products.

As part of this review, You authorize Spectra and the Recipients to obtain consumer/personal and/or business and investigative financial and credit reports from one or more consumer reporting agencies (including, but not limited to, TransUnion, Experian, Equifax, and Dun and Bradstreet) and from other credit bureaus, banks, creditors and other third parties about You and Your business. You further authorize and understand that Spectra and the Recipient, respectively and individually, may obtain statements from creditors, financial institutions, and other third parties, as well as other information about You and Your business, including credit card processor statements and bank statements. You further authorize and understand that Spectra and the Recipient, respectively and individually, may obtain Your tax return information from the appropriate tax authorities or through utilizing the services of third parties.

You authorize Spectra and the Recipients to obtain Your credit report, during review of any application submitted via https://spectralending.com, including any subdomains, any co-branded websites, or any other website where this Credit Gathering Authorization may be agreed to, during the closing of any financial product, or at various times during the term of the financial product(s) You receive in connection with its servicing or enforcement. This authorization shall constitute Your written instructions under the Fair Credit Reporting Act, as amended. You further authorize Spectra and each Recipient to contact third parties to verify any information provided in Your credit report or otherwise submitted to Spectra or the Recipients in connection with Your application for financial products.

You hereby acknowledge that Spectra and the Recipients may use the information You provide (including, without limitation, the information referenced herein) for evaluating and processing Your application, including, without limitation, for the following purposes: (a) processing and underwriting the loan application; (b) verifying any data contained in consumer reports, the loan application, or other documentation or information relating to me or my loan application; (c) making credit and investment decisions; (d) performing audit, quality-control, and legal-compliance analysis and reviews; (e) performing analysis and modeling for risk assessments; (f) monitoring the account for this loan for potential delinquencies and for determining any assistance that may be available to me; and (g) any other actions permissible under applicable law.

You confirm that the information You have provided to Spectra as part of Your application, as well as any subsequent information that might be submitted as part of Your application, is true, accurate, correct, and complete and may be relied upon by Spectra and the Recipients in their consideration of Your application. Any misrepresentation that You make in conjunction with the information You submit may result in civil liability and/or criminal penalties and may be viewed as fraud punishable by law. If any of the information You provided to Spectra changes prior to the consummation of the transaction requested in Your application, You will immediately Notify Spectra in writing.
